Puppy Contract
The following is a copy of the Puppy Contract that will be required and sent upon any deposit or sale of any puppy. This is subject to change before it is changed on the website, so always review the contract that you receive before signing:

Puppy Agreement
This agreement is made on ______________ by and between Round Hill Retrievers LLC (SELLER) and ________________ (BUYER) to purchase the following puppy:

Conditions of Sale
1. Deposit, Payment of Purchase Price, Fees
Buyer has paid a deposit of ____________, with payment of the balance of ___________ due upon delivery of the Puppy to Buyer. The expected delivery/pickup date is TBD, or such other date as the parties may mutually agree. The Puppy will be weaned prior to the expected delivery date and no sooner than 8 weeks of age. Payment of the balance may be made by cash, card, Venmo, or CashApp. All virtual and card payments require sales tax and applicable credit card fees.
Buyer acknowledges and agrees that Buyer will forfeit the deposit and any rights to the Puppy if:
(a) Buyer fails to complete the purchase of the Puppy for any reason, or
(b) Buyer fails to pay the balance of the Purchase Price at delivery of the Puppy.
In either event, Seller shall be free to sell the Puppy to another party.
In the event that the Puppy is not available due to sickness, death, or any other circumstance owing to the fault of Seller, Buyer’s deposit will, at Buyer’s option, be either (i) refunded, or (ii) transferred to the next litter of puppies.
A boarding fee of $10 per day will be charged for each day the Puppy is boarded by Seller past the agreed delivery date.
2. Transfer of Ownership and Registration
Upon payment in full of the Purchase Price, Seller (at Seller’s sole cost) shall promptly take all actions required to officially transfer ownership and registration (limited/full) of the Puppy to Buyer.
3. Seller’s Representations and Warranties
Seller represents and warrants to Buyer that:
(a) Seller is the legal and true owner of the Puppy and that Seller has full right and authority to sell the Puppy.
(b) The Puppy is being sold free and clear of any lien, security interest, charge or other encumbrance.
(c) Seller guarantees that the Puppy is a purebred dog, offspring of the purebred father and purebred mother set out on page 1 of this Agreement.
(d) The Puppy is in good health and free of communicable diseases at the time of delivery. Buyer has three (3) days from the delivery date to have the Puppy examined by a licensed veterinarian, at Buyer’s sole cost. If the Puppy fails the examination, Buyer may return the Puppy, with a written statement from the veterinarian, for a different puppy, if available, or, if not immediately available, from the next litter. Failure by Buyer to have the Puppy examined within the three-day period will nullify this warranty. The only other instance in which the Puppy can be exchanged for a new puppy is if the veterinarian has documented a life-threatening illness within six (6) months from the date of delivery. For purposes of this paragraph, poor health does not include a diagnosis of worms. While it is generally recognized that intestinal parasites are common in puppies, and part of the puppy’s early development, Seller will make every effort to prevent such parasites. Often, the stress of change and travel can cause intestinal parasites to emerge after the puppy has left its mother. If follow up vaccinations, preventative treatments, and other required care are not documented, this health guarantee will be void. If Buyer chooses to keep the Puppy, no replacement will be given, all medical costs and treatment are the sole responsibility of the Buyer, and this health guarantee will be null and void.
(e) This Guarantee does NOT cover Cherry eye, Entropion, Ectropion, Allergies, undescended testicles, loose knees or hips, Stenotic nares, elongated soft pallet, umbilical hernia, dermatitis, demodetic mange. Seller will NOT replace a puppy due to heat stroke, abuse/neglect, or improper socialization. Buyer agrees that they have thoroughly researched the Labrador Retriever breed, and understands the possible health issues they can possess. Buyer is responsible for all medical costs of the Puppy. (No refunds will be given, except as expressly set forth above.)
This Guarantee covers only the original Buyer and is not transferable.
If Buyer can no longer care for the Puppy, Seller will take the Puppy back at any time during the Puppy’s lifetime, and/or assist in finding a new home for the Puppy.
Seller guarantees the Puppy’s deworming and immunizations have been completed as follows:
- The Puppy will have been dewormed at ages 2 weeks, 4 weeks, 6 weeks, and 8 weeks of age, and the puppies’ vaccinations will be administered at 6 weeks and 8 weeks of age. Puppies picked up after 8 weeks of age will continue to follow the appropriate deworming and vaccine schedule until sold.
4. Disclaimers
(a) The Puppy was bred as a companion animal, and Seller does not provide any warranty as to the Puppy’s fitness for any specific purpose, including obedience trials, show ring performance, and/or breeding purposes.
(b) Seller recommends training the Puppy beginning with Puppy Kindergarten classes to ensure the Puppy learns appropriate behavior. Seller can provide recommendations for trainers upon request. Normal puppy behavior (barking, nipping, learning curves, etc.) are expected and require training. They do not warrant a reason for return
5. Buyer’s Representations
Buyer represents to Seller that:
(a) The Puppy will reside with Buyer as companion pet to Buyer and Buyer’s family.
(b) Buyer will keep the Puppy in an enclosed area of adequate size, and will not allow the Puppy to roam at will. Buyer will not keep the Puppy chained or tethered or permanently house the Puppy in a kennel.
(c) Buyer will follow veterinarian recommendations and provide the Puppy with nutritious food and necessary veterinary care, including de-worming, heartworm prevention and regular vaccinations (including rabies).
(d) Buyer is not acting as agent for any other person or business in the purchase of the Puppy.
(e) Buyer will not sell, give, or release the Puppy to a pet shop, retail store, dog dealer, animal testing facility, research facility, or an agent for any such business or facility.
(f) In the event Buyer sells the Puppy to a new owner, Buyer shall ensure that the new owner agrees in writing to comply with the terms of this Agreement. Original Seller must be notified of a change in ownership.
(g) If issues arise with behaviors, health, or any other concerns, Buyer will notify Seller so adjustments can be made to the breeding program.
(h) Buyer is responsible for any transportation or transport issues that may arise, and must research the best way to transport and transition the Puppy to their new home.
6. Indemnity and Release
If any action or failure to act on the part of Buyer shall result in any claim, suit, loss, damage, injury, death, or liability, Buyer agrees to defend, indemnify, and hold Seller harmless and to pay all of Seller’s costs and expenses, including reasonable legal fees, any amount paid in settlement and any award or judgment with respect thereto. Buyer releases Seller from any and all liability, costs or damages caused by the Puppy after placement with Seller, including but not limited to damage to or destruction of property, and injury to any person.
7. Limitation of Action
Any action or claim brought by Buyer against Seller for breach of this Agreement or for loss due to negligence must be brought within one (1) year of the date such claim or loss occurs.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Connecticut.
9. Entire Agreement
This Agreement represents the entire agreement between the parties. Seller and Buyer have made no other agreements, promises, representations or warranties, express or implied, unless specifically stated in this Agreement.
